1.1 This website is operated by Garadry LLC ("Garadry"). We are a limited liability company registered in the United States of America. To contact us please click here.
1.2 Any and all personal information given to us by you will be held securely. We explicitly do not sell or pass this information to any third parties.
2.1 We will confirm acceptance of your order placed on the Garadry website. Confirmation will be sent either via the website immediately after purchase of goods or by e-mail to the e-mail address supplied at the time of ordering. At the point of acceptance the purchase contract will be formed and goods will be supplied to you by us in accordance with your order and these Terms and Conditions.
2.2 Unless you have requested not to be contacted by email we will endeavour to send you an email with tracking information for your order (providing a valid contact email address has been provided).
3. Item Costs and Delivery Costs
3.1 The price of the goods will be as quoted on the website at the time you confirm your order (usually by clicking the "checkout" button). Any inadvertent technical errors will render orders as void and we will not be liable for or bound by any such technical errors.
3.2 The customer will be the importer of record and, as such, will be liable for any import duties and taxes applicable for shipments to you.
3.3 If Garadry makes an error with regard to the advertised price of the items on the website, it shall reserve the right to cancel any orders you place for such items.
3.4 Orders made may include a charge for delivery. If your order is subject to a delivery charge, it will be shown to you as a separate charge on the checkout page before you place your order. Any delivery charge added to your order will be dependent upon, amongst other factors, the value of your order, the weight of your order, the date and time of your delivery and your delivery address.
3.5 Unless otherwise expressly stated all quotations issued are valid for 30 days from the date of quotation and are in U.S. dollars.
3.6 Customers based outside of the contiguous US: Please note, payment for goods and delivery for orders placed online do not include any additional fees that may arise based on your delivery location. This includes but is not limited to; Import Duty, Taxes, Customs fees or processing fees. In the event these costs arise, they are the sole liability of the customer unless otherwise expressly agreed in writing by Garadry.
4.1 Orders may be paid for by debit or credit card, PayPal or bank transfer. You cannot pay for your order by cash or check.
4.2 The debit, credit and charge cards accepted by us are those listed on the website.
4.3 Garadry will charge your credit card or other payment method at the time the order is placed, even though your order may not ship that same day. Most orders ship within 1 business day with the exception of back orders and custom products. Larger orders, custom orders and back orders can take longer to ship. Please contact us for details.
5.1 All orders are dispatched by third party common carriers ("courier") with a 2-3 business day delivery timescale, but occasionally delays may occur beyond our control. We shall not be liable for delivery delays either caused by us or beyond our control. We reserve the right to restrict deliveries in particular areas.
5.2 Deliveries are made on a working day basis (Monday-Friday). It is the customer’s responsibility to ensure that an appropriate person is available at the delivery address on the specified delivery day in order to sign for the safe delivery of the goods. If there is nobody present at the address at the time that delivery is attempted, our courier will leave appropriate notification of the attempted delivery as well as instructions for the re-delivery of the order.
5.3 Products are subject to availability. If items ordered are not readily available we may contact you to offer a reasonable substitute. Please be aware that this may affect the price you pay. We will only provide substituted items at your request. Otherwise, a full refund will be granted for items which become unavailable.
5.4 Severe adverse weather conditions and other events outside of our reasonable control could result in a cancelled/delayed delivery. If a delivery is delayed or cancelled, Garadry will endeavour to reschedule the delivery at the earliest opportunity.
5.5 The couriers will usually only make deliveries when an appropriate person is able to take receipt of the delivery. If you should instruct Garadry to leave a delivery with a neighbour / in a safe place, Garadry expressly disclaims any liability which may arise as a result of the delivery being left somewhere other than the recipient’s delivery address, including but not limited to theft, tampering or damage.
5.6 Upon delivery of your order, you must check the contents to ensure that your order is complete and that you are satisfied with the condition of the goods. If an item is missing/damaged/incomplete you must notify Garadry in writing within 24 – 72 hours from the time of delivery. Any order may be returned to us for a refund or replacement within this period. Please refer to our returns page for more information regarding returns. Any damage to the shipment must be noted to the courier and on their shipping document. Concealed damage to the product(s) must be reported immediately to Garadry, typically within 24 – 72 hours.
5.7 Do not return a product without first getting authorization to do so. Any unauthorized returns received by Garadry will be returned to the customer, at their expense and no refund will be given.
5.8 For unwanted items, return costs are to be met by the customer. Any items found to be damaged or in unsaleable condition will be returned to the customer at their expense with no refund given.
5.9 All quoted delivery timescales are given as an estimate only on the likely time for the order to arrive. Garadry will make every reasonable effort to comply with such estimates but will not be liable to pay damages, compensation or grant cancellation of the order by reason only of failure to meet the stated delivery date.
6.1 If for any reason you’re not happy with an item you’ve ordered, we’ll gladly refund it – simply email us at firstname.lastname@example.org as soon as possible with your order number, and we will be able to provide you with a Return Merchandise Authorization number and go through your returns options.
6.2 Any unwanted goods must be notified to us within 14 days from the day of delivery. From the date of notifying us, a further 14 days is provided for the goods to arrive with us at our premises (recorded/tracked delivery only). Goods received outside this period will not be accepted.
6.3 Items must be returned in the same condition as it arrived with you.
6.4 Items must not be used or installed and removed and then returned.
6.5 Unauthorized returns will not be refunded. Any items returned without authorization will be returned to the customer at their expense.
6.6 Missing or Faulty goods - If you discover a product is faulty, please call our Customer Service team within 14 days from the date of delivery at 866-563-2707 or email email@example.com
7.1 We will not be deemed to be in breach of contract or in breach of these Terms and Conditions as a result of any delay in our performance/failure to perform our obligations if that delay or failure was brought about by circumstances beyond our reasonable control including, but not limited to, flooding, fire, force majeure, acts of God, strikes, acts of terrorism, accident or road traffic problems.
7.2 All goods supplied by Garadry are fit for the normal purpose for which such goods were intended. Garadry will not be liable if the goods are found unsuitable for any other purpose. Any recommendations made by Garadry in such circumstances are made in good faith but as the installation of the product is outside of our control, it is for the customer to satisfy themselves as to the suitability of the goods for the intended purpose.
7.3.1 Garadry will not be under any liability in respect of any defect arising from misuse or alteration of a product, wilful damage, negligence, abnormal working conditions and failure to follow our instructions whether oral or in writing. The supplied warranty will be void if any steps of the fitting instructions are not followed including, but not limited to, failure to seal/prepare the floor correctly prior to installation, failure to follow the adhesive temperature guidelines or any action directly contradicting any step within the fitting instructions.
7.3.2 All threshold seals should be fitted by a mature adult and due care and attention should be paid when stepping over the threshold seal.
7.4 All Garadry branded products carry a 5 year manufacturer’s guarantee (effective on all orders from January 1st 2017). This guarantee applies only to goods used within normal operating conditions and for the purpose intended. In cases where adhesive is to be used, only the supplied Garadry branded sealant & adhesive is to be used. In cases where an alternative adhesive has been used in any or all of the installation, this guarantee will be null and void. If an alternative sealant is suspected of having been used, Garadry reserves the right to inspect any seal or sealant in question prior to making a decision on any guarantee claim. The guarantee does not apply to any product that has been exposed to abnormal operating conditions including excessive weight loads, excessive speed when crossing the threshold seal or chemicals such as fuels, acids or unstable compounds. Any and all applicable warranty will be void if the supplied fitting instructions are not followed. The warranty period covers all eligible purchases for 1 (one) like-for-like replacement. Different products may be offered as replacements at the discretion of Garadry if the intended use is unsuitable for the product originally purchased.
7.5 Under no circumstances shall Garadry's liability exceed the purchase price of the goods in respect of which damages are claimed.
7.6 Under no circumstances will Garadry's liability exceed the replacement or refunding of the product you purchased. Garadry will not be responsible for incidental or consequential damages. All information is provided “as is” and is believed to be accurate at the time of publication.
7.7 Limitation of liability – The obligation of Garadry and the buyer’s sole remedy, shall be the supply of replacement products for the failed material from regular product inventory lines. Garadry will not be liable for the labor or any of the costs incurred in the repair or replacement of products nor shall Garadry be liable in contract, in tort (including negligence), or otherwise for damage or loss of other property, loss of profits or revenue, loss of use of property or equipment, claims of customers or buyers, or for any special indirect, incidental, or consequential damages whatsoever.
8. Faulty Goods
8.1 Any damage to the shipment must be noted to the courier and on their shipping document. Concealed damage to the product(s) must be reported immediately to Garadry, within 24 – 72 hours.
9.1 Unless an item has been personalised or made to order you will have the right to cancel the contract with us at any time up to 14 days after the date of delivery. You must notify us of your wish to cancel your order in writing, either by letter or e-mail.
9.2 With your assistance we can arrange for cancelled orders to be returned to us (at your cost) and we will endeavour to credit your payment card for the cost of the goods within 2-3 working days.

11. Special Offers
11.1 We have the right to make changes to the terms of special offers, or withdraw them completely at any time and without prior notice.
12.1 If any of these Terms and Conditions is deemed by any court to be unlawful, invalid or unenforceable, either in whole or in part, this will not affect the validity of the remaining Terms and Conditions which will be valid and enforceable.
13. Trade/Reseller Accounts
13.1 Any customer that is a registered business will for all intents and purposes, with regards to these terms and conditions, be considered a "trade customer".
13.2 Purchase Orders - You agree and acknowledge that we shall be under no obligation to include any purchase order number(s) from you on our invoices.
13.3 Invoices - The format of our invoice and statements to you will solely be dictated by us and we will not enter into any variation of our format unless any proposed variations are requested in writing at least six months in advance and expressly agreed by us. Any cost of an agreed variation shall be borne by you unless expressly agreed otherwise.
13.4 Responsibilities - We may close the Account at any time with immediate effect, on us giving you notice verbally or in writing if you break any of these terms or the terms on which you purchased goods or if any of the following happens (or we reasonably believe is likely to happen): i) repeated incidents of invoices becoming past due; ii) any use of intellectual property, including but not limited to, digital media, logos, product descriptions or trademarks without prior written consent; iii) failure to use the word "Garadry" to identify our products in any product listing titles, whether online or otherwise; iv) if we are made aware of any information suggesting the pending winding down or closure of the customer's business; v) if we are unable to make contact with the customer for a prolonged period of 14 days or longer without explanation.
13.5 We may send you any notice at the address specified on your application form, any trading address you may have from time to time, or at any other address you notify to us in writing and you must tell us if you change your address. Any notices must be given by first class post and will be regarded as served 2 days after the date of posting. If we relax any of these terms, this may be just a temporary measure or a special case, and we may strictly enforce the term(s) again at any time.
13.6 Fraud - You must tell us immediately if you become aware that the Account is being misused, whether fraudulently or in any other way; if access to the Account has been compromised, stolen or misused; or an Account invoice appears to wrongly include any item. Until you notify us of these events, so that we can stop the use of the Account or investigate any misuse of the Account, you will be liable for any losses we suffer as a result of any misuse of the Account. Where we have good reason to do so, we may cancel, suspend or restrict the right to use the Account.
13.7 Trade order returns - You will be responsible for all shipping costs incurred on any returns accepted by us.
10.2 We reserve the right to refuse any trade returns.
10.3 We reserve the right to charge a restocking fee for any accepted trade returns solely at our discretion. If a restocking fee is applicable this will be 25% of the cost of the goods.
